In 2014, SJC Chief Justice Ralph D. Gants and Trial Court Chief Justice Paula M Carey created separate, multidisciplinary working groups to develop evidenced-based sentencing protocols specifically for the Boston Municipal, District, Juvenile and Superior Courts.

Issued in 2016, each court published particularized procedures and practices that promoted sentencing “best practices” tailored to the types of criminal cases handled by those courts.

The court-by-court protocols match the purposes of sentencing with social-science data and empirical research to determine the best, evidence-based practices to enhance the effectiveness of probation and reduce overall recidivism.

This program will specifically focus on the best sentencing practices designed for the Superior Court. Adapted from a presentation to the Superior Court bench, this training for the bar will provide a summary of the research underlying evidence-based sentencing precepts, will review the application of the specific practices adopted by the Superior Court, and will provide both prosecutors and defense counsel insight on the practical implications of the new sentencing protocols.

The Superior Court’s publication, “Criminal Sentencing in the Superior Court: Best Practices for Individualized Evidenced-Based Sentencing,” will be among the course materials. It provides members of both bench and bar with both Commentary and a detailed description of the seventeen Best Practices adopted by the Court, as well as sections on Resources, Selected Statues, Drug Sentences, Fees, and Probation Violations.
